1. Definitions
"We", "us", "our" means Philbert Construction Ltd, company number 11797167, registered at 14 Willow Road, Tadley, RG26 4LU. "Client", "you" means the person or entity instructing us to carry out work.
2. Quotes
Written quotes are valid for 60 days from issue. Quotes are itemised by labour, materials and timing. Verbal estimates are indicative only and not binding until a written quote is issued and accepted in writing.
3. Variations
Any change to the agreed scope must be confirmed in writing (email is sufficient) and will be priced as a separate variation before the change is carried out. We do not bill for variations after the fact without prior written approval.
4. Payment terms
- Projects under £2,000: payable in full on completion.
- Projects £2,000–£15,000: 30% on commencement, balance on completion.
- Projects above £15,000: agreed stage payments tied to defined milestones.
- Invoices are due within 7 days. Late payment may attract statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.
5. Materials
Title in materials passes to you only on full payment of the relevant invoice. We reserve the right to remove unpaid materials. Bespoke or special-order items are non-refundable once ordered.
6. Workmanship
We carry out work to a professional standard and stand behind the work we deliver. We do not offer formal written guarantees or warranties. Where defects in our workmanship come to light, we ask you to contact us promptly so we can review and, where appropriate, put matters right. Nothing in these terms affects your statutory rights as a consumer, or any product warranties offered separately by manufacturers and suppliers.
7. Access & site conditions
You agree to provide safe, reasonable access to the site during working hours, an outdoor tap, and a 13A power supply. Programme dates assume continuous access; delays caused by restricted access may attract reasonable standing charges.
8. Cancellation
You may cancel before work begins by giving 7 days' written notice. Materials specifically ordered and non-returnable will be invoiced. Where work has commenced, you will be invoiced for labour and materials supplied up to the point of cancellation.
9. Liability
We carry public liability and employers' liability insurance. Certificates are available on request. Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
10. Disputes
Both parties agree to attempt resolution through good-faith discussion before formal proceedings. These terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.
11. Contact
Any notice should be sent to philbertconstruction@gmail.com or by post to the registered address above.
